OCWEN LOAN SERVICING LLC (B OF A)


OCWEN (B OF A) COMPLAINT:

Ocwen Loan Servicing, Green Tree, Nationstar all collections of Bank of America or Banc of America Ocwen to over a property and changed locks and started foreclosure on my 8husband because he is a very sick Vietnam veteran and I now have his Power of Attorney. Bank of America foreclosed on all of our properties in September 2010 and we were intimidated as to the hoops we had to jump through to get them out of foreclosure. The in June of 2011, Bank of America began to pass off our mortgages to other companies with even notifying us. Now all of a sudden in the last two months Ocwen has been sending emails that payments are being made on the account. The last payment was November 2, 2014 in the amount of over $3,200.00. When I looked on line about how they received payment it stated the past 3 payments are suspense payments. What is a suspense payment and why did they take over the property way before foreclosure in give it to another rental company and change the locks. The bank and these so called mortgage agencies are stealing our properties. I have documentation against them all I just need a Greensboro North Carolina

It seems to be that Bank of America is the heading of all these scams by Ocwen, Nationstar, and GreenTree Servicing companies.

I need an attorney because Bank of America has passed properties on to the Debt collectors when the loans were not in debt. Now I have received an email from Ocwen stating a $3,200 PAYMENT WAS made on our loan on November 2, 2014. When I went online to see where the payment came from it stated it was a suspense payment. What is a suspense payment. I have all documentation, and a very good case against Bank of America and these so called mortgage companies that are handling these loans with intimidation and rudeness. I am in Virginia so if there is a Virginia attorney that can help us please contact us. My husband is a very sick Vietnam veteran and I am disabled and on chemo and have to have surgery. I don’t know how much more of these people I can take.

We routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need.  The debt collectors like SPS, SLS, Green Tree, Ocwen and Nationstar are simply just piranhas but they can be beat at their own game too just like the big banks can be defeated.  You CAN win this fight!!!

It pains me that you have fallen victim to the illegal, unfair, deceptive and abusive acts and practices of Ocwen, Bank of America, Nationstar and Green Tree but I also commend you for seeking help; too often homeowners do not fight for their consumer and constitutional rights! 

With that said, you have overlooked a key aspect to your fight, which is putting your objections in writing in the form of a proper QWR and attaching proof of your consumer and Constitutional rights; they have certainly been violated in this case as you have a right to know if you still own the loan and the current status of the loan.  All of the aforementioned mortgage lending and debt collection companies MUST answer your Qualified Written Requests (QWR) and if they refuse to then you take your fight to all the regulatory agencies outside of Ocwen and Bank of America et al that assist in fighting for your rights like the CFPB; it’s a shame that these more than profitable and previously bailed-out companies engage in this type of consumer abuse.
