NATIONSTAR MORTGAGE

NATIONSTAR COMPLAINT:

Loan Modification Fraud

Have been dealing with Nationstar as a mortgage servicer for the last 4-5 years.  Several instances of unexplained charges on billing, but nothing of a major issue.  Until now.  Was injured on the job June of 2013, have been unsuccessful in collecting workers comp. Wages a have declined due to my injury to around 35-40% of my previous income.  have used savings to keep up until january 2015.

Received invitation from Nationstar in Marrch 2014 to Refinance.  Responded by phone, to initiate process.  Had an assigned " Loan Specialist"  Called back next day to provide additional information that had been requeested, and was advised that the individual that had been assigned as my "loan specialist" was no longer employed by nationstar. Next "loan specialist" after requesting income and employment verification sent me a letter approximately a week later that stated that I did not meet criteria fror a refinance.

Received letter from Nationstar dated March 9, 2015, stating that upron their review, my mortgage qualified for modification.  The letter states" To accept this option, within 14 days of the date of this letter you must call us at (877)450-8638 to confirm your participation or make your first Trial period payment.  If you follow the terms of the enclosed Trial Period Plan, your loan will be permanently modified."

The last sentence in the previous paragraphcan be interpreted in a legal proceeding as nothibng but an absolute confirmation of actiion!  But that's not the Natiionstar way.  After making three timely payments that the Trial Period Plan called for, I recieved a Letter from Nationstar on June 18,2015 with the following statement.  " We recently received a payment on your behalf in the amount of $807.04.  We are  returning these funds as they are insufficient to bring your account current.  As of the date of this letter, the total amount required to bring this account current is $6,732.79."

To date there has been no accounting from Nationstar of the disposition of the first 2 Trial Plan payments, nor has the payment referred to in the June 18.2015 letter been returned.  Current status is threat to resume foreclosure proceedings.

My intent is to use my limited resources to file an action against Nationstar and their "Dedicated Loan Specialist" Kyle Lindgard for Fraud.

END CONSULTING ADVICE:

Hi Bob,

It is absolutely disgraceful how Nationstar Mortgage has treated you not to mention a violation of your consumer rights. With that said, you do have rights and by simply understanding them and knowing how to exercise them, you can hold Nationstar Mortgage accountable for their actions while securing a permanent loan modification since you have already complied with the Trial Period Plan (TPP).

I would first suggest that you visit the CFPB's website (click here for CFPB website) to learn more about your consumer rights and you will also want to contact the Making Home Affordable (MHA) Home Affordable Modification Program (HAMP) escalations team to get them involved with your mortgage loan and successful TPP completion.

We battle Nationstar Mortgage daily and win with a trial period plan issues as well as other debt restructuring issues so just keep fighting until you get the solution that you are seeking. We would be more than happy to educate you as to how to fight for your rights.  My firm routinely seeks out complaints online so that we can educate as to how to fight back on our weekday show called "The Daily Complaint" where we review a complaint and how to tackle it successfully.

We reviewed your Nationstar Mortgage complaint on the show if you would like to listen, click here.

In addition to submitting complaints to the CFPB and MHA HAMP escalations team, I would always suggest preparing a QWR or Request for information for Nationstar Mortgage that you can submit via fax or email – you can learn how through the CFPB by typing in QWR in their search bar.

Nationstar Mortgage is required to acknowledge the QWR or Request for information per RESPA in 5 business days and answer it in 30 business days or you do have recourse, so listen to us address the Nationstar Mortgage issues on The Daily Complaint today and contact us if you need further information on how to not only attack your problem but to get the solutions that you are seeking.

Good luck!

NATIONSTAR MORTGAGE

NATIONSTAR COMPLAINT:

Submitted:      July 2015
Reported By:     John Maresca in Cherry Hill, NJ
Report Link:   CLICKHERE

Won't Send Me My Money

My mortgage was sold to Nationstar by Bank of America. I immediately looked up the company and saw reviews of how terrible their service, customer support, and website was. I also saw the lawsuits brought upon Nationstar. I immediately refinanced with Quicken. My mortgage was paid off a month ago and they won't send my large escrow check to me. They're sitting on it probably to make interest off of it. I was given conflicting information from different customer support people about my check being sent, not being sent, dates the money cleared, etc. That's when I could get through to anyone. They won't send my check in anything with a tracking number or bank wire. They're straight up liars and thieves. Do everything in your power to stay FAR AWAY from this company!

END CONSULTING ADVICE:

Hi John,

Nationstar Mortgage is known for violating the rights of their clients and consumers as you know but you do not have to sit back and take it! You have so many consumer rights and consumer protections afforded you and the CFPB would be an excellent place to start to voice your complaint as it only takes a few minutes to submit the complaint online to the CFPB and you do not have to deal with any Nationstar Mortgage customer service runarounds anymore. Your NJ Attorney General would also be an excellent person as well to voice your concerns.

In fact, we covered your complaint today on our radio show The Daily Complaint and provided a pathway for success to include how to contact the CFPB - thank you for posting your complaint online via Complaints Board so that others will have the opportunity to learn from your experiences in dealing with Nationstar Mortgage. There are firm rules in place with regard to escrow accounts and correcting errors made by the servicer in a timely manner but you must know your rights in order to exercise your rights.

In addition to submitting complaints to the CFPB and the NJ AG, I would suggest preparing a QWR or Request for information for Nationstar Mortgage that you can submit via fax or email – you can learn how through the CFPB by typing in QWR in their search bar and you never have to speak with them again. They are required to acknowledge the QWR or Request for information per RESPA in 5 business days and answer it in 30 business days or you do have recourse, so listen to us address your complaint on The Daily Complaint today and contact us if you need further information on how to not only attack your problem but to get the solutions that you are seeking. You can absolutely hold Nationstar Mortgage accountable for their actions while obtaining your refund in an expeditious manner.

Good luck!

SPECIALIZED LOAN SERVICING

SLS COMPLAINT:

Submitted:      June 2015
Reported By:     SLS Victim Clare in Milwaukee, WI
Report Link:   CLICK HERE

False Delinquency Notice

Our mortgage was bought by Specialized Loan Servicing from our original mortgage holder about 18 months ago.
We had no problem until recently when we received a delinquent payment notice from a COLLECTION AGENCY. SLS claimed that we had not made our June payment. We had made the June payment early as we were going to be out of the country after May 25, 2015.
I attempted to call SLS as soon as I saw the delinquency notice. After a 10 minute wait - accompanied by loud music - I was connected with "Erika". She informed me that the May 20th early payment was viewed as an addition to the original May payment. She asked for a phone contact number, which I supplied. She said the situation would be rectified the next morning (June 30). She announced she needed to put me on hold. I requested no music. She said she would put me on "mute". In the process we were disconnected. Since I had just given her my phone number, I assumed that she would use it to call me back. Nothing.
I do not wish to be subjected to another annoying 10 minute episode of music. I therefore await a return call - preferably from FREDERICK KORB or DOLORES GILDEN to settle this matter immediately.

END CONSULTING ADVICE:

Hi SLS Victim Clare,

You are so right to be upset about the delinquency notice you received from a collection agency and about the actions of SLS with regard to posting your payment as I can completely validate your complaints after many dealings with SLS. I commend you for voicing your concerns as it is an important step in asserting your consumer rights.

You have so many consumer rights and consumer protections under the FDCPA and the CFPB and the FTC and RESPA with regard to your complaint and it only takes a few minutes to submit the complaints online to the CFPB and FTC for an immediate response and action.

In fact, we covered your complaint today on our radio show The Daily Complaint and provided a pathway for success to include how to contact the CFPB and the FTC - thank you for posting your complaint online via Complaints Board so that others will have the opportunity to learn from your experiences in dealing with SLS. There are firm rules in place with regard to the posting of your payments and correcting errors made by the servicer in a timely manner, you must know your rights in order to exercise your rights.

In addition to submitting complaints to the CFPB, I would suggest preparing a QWR or Notice of Error for SLS – you can learn how through the CFPB by typing in QWR in their search bar and you never have to speak with them or listen to that awful hold music again. They are required to acknowledge the QWR or Notice of Error per RESPA in 5 business days and answer it in 30 business days or you do have recourse, so listen to us address your complaint on The Daily Complaint today and contact us if you need further information on how to not only attack your problem but to get the solutions that you are seeking. You can hold SLS accountable for their actions!

Good luck!
